Stallion Service Contract


BREEDING FEE:

The undersigned, owner of the Mare________________, AHR#__________, hereby agrees to breed said mare to the stallion, ________________, AHR# ____________, standing at Red Rock Arabians, and to pay a breeding fee of $1,000.00. The breeding fee is due before departure of the mare from RRA, or in the case of shipped semen, the balance is due before the semen is to be shipped, unless other arrangements have been made with RRA.

OTHER EXPENSES:

It is understood and agreed that in addition to the above stated fee, the mare owner shall pay for the cost of stallion collection. Stallion collection is $250.00 per collection. In the case of transported semen, the Mare Owner is responsible for paying the shipping cost. In addition there is a deposit of $300.00 for the equitainer. The equitainer must be returned within 72 hours or a $100.00 late charge shall apply. Board expenses are at a rate of $7.50 per day for open mare, or $10.00 per day for a mare and foal, plus veterinarian expenses including drugs, medications, and supplies as required, farrier expenses and all other expenses reasonable and necessary to insure the well-being of the mare. Red Rock Arabians shall render monthly detailed statements of all such charges and payments shall be made promptly and must be paid in full before the departure of the mare.

CONDITIONS FOR ACCEPTANCE:

The mare must be halter broke and able to be handled. Prior to or at the time of arrival of the mare, a copy of mare's registration papers shall be furnished to Red Rock Arabians. Culturing of the mare is highly recommended. The mare should be in good health. Mares should have current vaccinations and worming. Red Rock Arabians reserves the right to refuse acceptance of the mare under this agreement, if a major medical problem arises which would preclude the breeding of said mare. Upon notification, this contract shall terminate and the parties shall be relieved of any further obligation or liability. The mare owner has an obligation to remove the mare from RRA at mare owners expense, at which time all outstanding bills are to be paid. The mare owner has the option at this time, to substitute another mare to complete this contract.

LIVE FOAL GUARANTEE

Red Rock Arabians guarantees a live foal from the mating. A live foal is defined for the purpose hereof as one which stands and nurses. Should the mare abort at any time after her departure or should her foal be born dead, the mare owner is guaranteed a return privilege for the same mare or a substitute mare, during the same season or the following calendar year free of any additional fees except for any of the aforementioned fees and expenses.

CONTRACT NULLIFICATION:

It is understood that should the stallion die or become unfit for service, and the mare does not produce a foal, this contract will be declared null and void, in which case, all money paid as breeding fees only, shall be refunded to the owner of the mare. The mare owner has the option of breeding to one of the other stallions owned by Red Rock Arabians.

WAIVER OF LIABILITY:

Red Rock Arabians agrees to and shall exercise reasonable care, attention and judgement in the board, keep, maintenance, palpating and breeding of the mare and/or foal while on its premises, including any and all veterinarian procedures. Mare owner hereby waives any and all claims by reason of an such injury, escape, disability or death while on the premises of RRA.

GENERAL UNDERSTANDINGS:

The parties further agree as follows:

In the event of injury to or sickness of the mare and/or foal, Red Rock Arabians shall immediately notify the mare owner and, time permitting, will not perform or permit to be performed anything other than the usual conventional medical or veterinary procedures without prior consultation with the mare owner or his veterinarian:

This contract signed by the respective parties at the places and on the dates set forth below, constitutes the entire agreement between the parties and same may not be amended or modified, except by a mutual exchange of written instrument, nor may this contract or any rights or obligations hereunder be assigned without the prior written consent of both parties.
